Makah Whaling: Federal Law vs. 1855 Treaty

The plot thickens. The five Makah tribal members who killed a gray whale last September might be protected by the 1855 Treaty of Neah Bay, which grants them the right to hunt whales in the Pacific and the Strait of Juan de Fuca.

Or, they might have to obey the Marine Mammal Protection Act of 1972.

This Tuesday, lawyers for the Makah will argue in federal court that the Makah are protected by the 1855 treaty and hence not restricted by the Marine Mammal Protection Act.

Which law do you think should have a higher priority: the Treaty of Neah Bay of 1855 or the Marine Mammal Protection Act?

very FEW of the treaties enacted in 1855 were honored more than 10 years. So why should this tribe get any better treatment than any other tribe.
My own tribe was moved several times, and isn't even on original tribal lands. What are these guys bitching about!!

You know in this United States of America we have got us Freedom of Expresstions. We have fout hard for this and we will not give it up never! Libs want to take our Feedom of Expresstions away from Us but theyre crazy anyhow. Free peoples in this Nation will not let that happen!

As far as killing that whale goes, how much of this outrage is based on concern for animal rights, and how much is based on racism?

I AM an indian, you racist pig. However, my tribe isn't even on the lands of our ancestors, but on some stupid swamp land after three broken treaties, and a long, long miserable walk.
....These local indians are a bunch of spoiled babies.

Natives here have been hunting whales since cougars have been hunting deer. They have every right to take a whale, and have been better stewards of resources then we have. The intention of Greenpeace was to impact commercial whaling NOT native whaling. I am proud of the Makah for valuing their whaling rights over a casino, or other "gifts" let them whale, it's what they are.
